What is an Adult Dependant Relative Visa?

An Adult Dependant Relative visa enables an overseas adult of a British or Irish citizen, a person who is settled in the UK, a person with pre-settled status who was living in the UK before 1 January 2021, a person with refugee status or humanitarian protection in the UK to live in the UK so that they can receive long term care from their relative in the UK which they cannot receive in their home country.

What Are the Key Eligibility Requirements for an Adult Dependant Relative Visa?

In order to successfully apply for an Adult Dependant Relative visa, an applicant must meet the following key requirements:

  • Must be at least 18 years of age and are the parent, grandparent, brother or sister or the son or daughter of the applicant’s sponsor;
  • Must need long-term care to do everyday personal and household tasks because of illness, disability or their age;
  • The care the applicant needs is not available or affordable in the country the applicant lives in;
  • The person the applicant will be joining in the UK will be able to support, accommodate and care for the applicant without claiming public funds for at least 5 years; and
  • May need to provide a tuberculosis (TB) certificate depending on which country the applicant resides in.

How Long is an Adult Dependant Relative Visa for?

If an applicant is a family member of a British or Irish citizen, or a person who is settled in the UK, the applicant will be granted indefinite leave to remain and will not be required to apply for an extension or settlement. An applicant can therefore live in the UK indefinitely.

If an applicant is the family member of a person with pre-settled status who was living in the UK before 1 January 2021, the applicant can stay as long as their family member stays. An applicant will need to apply to extend or settle when they do.

If an applicant is the family member of a person who has refugee status or humanitarian protection in the UK, the applicant can stay as long as their family member stays. An applicant will need to apply to extend or settle when they do.

Will an Applicant be Eligible for British Citizenship?

An applicant will be eligible to apply for British Citizenship.

How Long Does it Take for a Decision to be Made?

The Home Office service standard for deciding an Adult Dependant Relative visa is 12 weeks (3 months), however, they are currently advising that applications should be decided within 24 weeks (6 months).

How Much Does it Cost?

The Home Office fee for an Adult Dependant Relative visa made from outside the UK is £3,250.
