What is Indefinite Leave to Remain?

The UK Immigration Rules enables individuals to apply for Indefinite Leave to Remain in the UK following a period of continuous lawful residence in the UK.

Indefinite Leave to Remain gives settled status in the UK, also known as ‘settlement’. It gives the right to live, work and study in the UK for as long as an applicant wishes to do so and apply for benefits if eligible.

There are several UK immigration routes that can lead to settlement including:

  • Family and Private life visas under Appendix FM of the Immigration Rules;
  • Work related visas, including the Skilled Worker visa and the Innovator visa;
  • Certain business visas such as the Tier 1 (Entrepreneur) visa; and
  • Long Residence.

What Are the Key Eligibility Requirements for Indefinite Leave to Remain?

Some of the key requirements applicants must meet (this list is not exhaustive), include the following:

  • Must have been living in the UK for a specific amount of time (depending on their immigration route);
  • Must have had continuous residence in the UK;
  • Must have passed the life in the UK test; and
  • Must meet the required level of English language.

Will an Applicant be Eligible for British Citizenship?

Once an applicant has held indefinite leave to remain in the UK for 12 months, an applicant may be eligible to apply for British Citizenship. If however an applicant is married to a British Citizen, an applicant will not need to wait 12 months and may be eligible to apply immediately for British Citizenship by naturalisation after obtaining Indefinite Leave to Remain.

Are Dependants Eligible for Indefinite Leave to Remain?

The partner and children of an applicant can also obtain Indefinite Leave to Remain so long as they satisfy the relevant criteria.

How Long Does it Take for a Decision to be Made?

It can take up to 6 months for the Home Office to make a decision on an application for indefinite leave to remain.

If eligible, applicants will be advised whether they can apply to get a decision faster. The Home Office charge additional fees for these priority services.

How Much Does it Cost?

The Home Office fee is £2,389.
